Terms & Conditions

These Terms and Conditions govern your use of the Suk Legal website (the "Site") and the engagement of legal services provided by Suk Legal ("we", "us", "our"), a legal practice registered and operating in Thailand. Please read them carefully. By using our Site or engaging our services, you agree to be bound by these terms.

1. Definitions

In these Terms and Conditions:

  • "Agreement" means these Terms and Conditions together with any Letter of Engagement issued to you.
  • "Services" means the legal services provided by Suk Legal, including Welcome Consultations, Pension Claim Assistance, and Full Matter Stewardship, as described on our Site.
  • "Site" means the Suk Legal website at suklegag.biz and any related pages.
  • "Client" or "You" means an individual who engages Suk Legal for legal services or who uses the Site.
  • "Content" means all text, images, documents, and other material appearing on the Site.
  • "Engagement" means a formal instruction from a client to Suk Legal to provide specified legal services, confirmed by a Letter of Engagement.

2. Acceptance of Terms

By accessing or using the Site, or by engaging our Services, you confirm that you:

  • Are at least 18 years of age;
  • Have the legal capacity to enter into a binding agreement;
  • Have read, understood, and agree to be bound by these Terms and Conditions;
  • Accept that these terms govern your use of the Site and, together with the Letter of Engagement, govern the provision of Services.

If you are engaging Services on behalf of another person or an organisation, you represent that you have the authority to bind that person or organisation to these terms.

3. Services

Suk Legal provides specialist legal services in relation to pension matters for individuals in Thailand. The three service levels currently offered are:

  • Welcome Consultation (฿2,200): An initial meeting to discuss your pension circumstances, understand your concerns, and outline what may be possible. This is an advisory session only; no ongoing representation is created unless a separate Engagement is entered into.
  • Pension Claim Assistance (฿7,000): Preparation, submission, and management of a pension claim or appeal, including document compilation and correspondence on your behalf.
  • Full Matter Stewardship (฿9,800): Comprehensive, ongoing management of a pension matter from initial review through to resolution, including all communication, representation, and periodic updates.

The scope of Services in any Engagement is defined by the Letter of Engagement. Suk Legal reserves the right to decline to act in any matter at its professional discretion. Services are available to individuals located in or connected to Thailand; international aspects may be accommodated where appropriate, as discussed at the time of Engagement.

4. Client Responsibilities

When using the Site or engaging our Services, you agree to:

  • Provide accurate, complete, and truthful information when requested;
  • Promptly supply documents, instructions, and authorisations necessary to progress your matter;
  • Notify us without delay of any changes to your circumstances that may affect your matter;
  • Use the Site only for lawful purposes and in a manner that does not infringe the rights of others;
  • Not attempt to gain unauthorised access to any part of the Site or its underlying systems;
  • Not use the Site to transmit unsolicited communications, malware, or harmful content of any kind.

Suk Legal cannot be held responsible for delays or adverse outcomes arising from incomplete or inaccurate information provided by the Client.

5. Engagement & Fees

Services are provided on the basis of a Letter of Engagement, which sets out the scope of work, the applicable fee, and any specific terms relevant to your matter.

  • Fees are stated in Thai Baht (฿) inclusive of applicable taxes unless otherwise stated in the Letter of Engagement.
  • Payment terms are specified in the Letter of Engagement. Services may not commence until agreed payment arrangements are in place.
  • For the Welcome Consultation, payment is due at the time of booking. This fee is non-refundable once the consultation has taken place.
  • For Claim Assistance and Full Matter Stewardship, payment schedules are agreed in advance. We do not require payment of fees not yet earned.
  • Out-of-pocket expenses necessarily incurred on your behalf (for example, filing fees or translation costs) are billed separately at cost and with prior notice wherever possible.
  • Where a matter does not proceed to completion through no fault of either party, fees are charged on a pro rata basis for work actually completed.

6. Confidentiality

Suk Legal is bound by strict professional confidentiality obligations as a registered member of the Thai Bar Council. All information you share with us in the context of an Engagement is treated as confidential and will not be disclosed to third parties except:

  • Where necessary to carry out the Services (for example, communicating with a pension authority on your behalf);
  • Where you have given explicit consent;
  • Where we are required to do so by law, court order, or a regulatory authority;
  • To our professional advisers who are bound by equivalent confidentiality obligations.

Confidentiality obligations survive the termination of an Engagement.

7. Intellectual Property

All Content on the Site — including text, design, layout, graphics, and documents — is the property of Suk Legal or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for your personal, non-commercial use only.

You may not reproduce, redistribute, publish, or commercially exploit any Content without our prior written consent. Any legal documents, opinions, or written advice prepared for you in an Engagement are provided for your personal use in connection with that matter and may not be reproduced for other purposes without our permission.

8. Disclaimers

The Site and its Content are provided for general informational purposes only. Nothing on the Site constitutes legal advice in relation to your specific circumstances. Legal advice is given only within the context of a formal Engagement confirmed by a Letter of Engagement.

We make reasonable efforts to ensure that information on the Site is accurate and current, but we do not warrant its completeness or fitness for any particular purpose. Pension law and regulation may change; we recommend you seek specific advice at the time you need it.

Suk Legal does not guarantee any particular outcome in any pension matter. The result of a claim or appeal depends on the specific facts and the decisions of the relevant authorities, which are outside our control.

9. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Suk Legal's total liability to you in connection with any matter shall not exceed the fees paid by you for the specific Engagement giving rise to the claim;
  • We shall not be liable for indirect, consequential, or special loss, loss of profit, or loss of opportunity, whether arising in contract, tort, or otherwise;
  • We shall not be liable for any loss arising from circumstances beyond our reasonable control, including changes in law, regulatory decisions, or the actions of third parties.

Nothing in these terms limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold harmless Suk Legal and its solicitors, employees, and representatives from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms and Conditions, your misuse of the Site, or any inaccurate or misleading information you have provided to us.

11. Termination

Either party may terminate an Engagement by giving written notice. Suk Legal may terminate an Engagement where:

  • You have not complied with our reasonable requests for instructions or information;
  • Continuing to act would place us in breach of our professional obligations;
  • A conflict of interest arises;
  • Fees or disbursements agreed in the Letter of Engagement remain unpaid.

On termination, you will be invoiced for all work completed to the date of termination. Clauses relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive termination.

12. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these terms or the Services shall be subject to the exclusive jurisdiction of the courts of Thailand.

Before initiating formal proceedings, we ask that you contact us at [email protected] to discuss the matter informally. We take all concerns seriously and will make reasonable efforts to resolve any disagreement promptly and fairly. If informal resolution is not possible within 30 days, either party may refer the dispute to the competent Thai courts.

13. General Provisions

  • Entire agreement: These terms, together with any Letter of Engagement, constitute the entire agreement between you and Suk Legal in respect of the subject matter herein, and supersede any prior communications.
  • Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
  • Waiver: Our failure to enforce any provision of these terms shall not constitute a waiver of our right to enforce it subsequently.
  • Assignment: You may not assign your rights or obligations under these terms without our prior written consent. We may assign our rights in connection with a practice restructuring, provided your interests are not adversely affected.
  • Notices: Formal notices should be sent to [email protected] or to our postal address below. We will communicate with you at the email or address you have provided.

14. Changes to Terms

We may update these Terms and Conditions from time to time to reflect changes in our Services, applicable law, or professional requirements. Where changes are material, we will publish a notice on the Site. Continued use of the Site or our Services following the posting of revised terms constitutes your acceptance of those changes. We recommend reviewing this page periodically.
